Furniture Mart Terms and Conditions
Deposits and Method of Payment: A standard 100% deposit is required to process Factory Direct and Online Orders.
Buyer(s) Responsibilities: It is the Buyer's responsibility to confirm the size and dimensions of the items purchased to ensure everything will fit in the designated room and through all entrance passages; doorways, hallways, stairwells, elevators, etc. Clear all obstacles in the designated space and path leading to it before delivery. Furniture Mart cannot warrant any particular item fitting into any specific area; therefore, cancellations will not be accepted.
Your order from Furniture Mart, whether Factory Direct or Online, is managed by independent delivery services who may charge extra for storage, damages, or scheduling. Furniture Mart’s quoted delivery fees are estimates and can change. Alert us to any potential delivery issues beforehand to prevent extra charges or delays. Additional fees may apply for remote locations or unexpected delivery challenges like narrow elevators or multiple flights of stairs. By placing an order, you accept these terms.
Furniture Mart does not assemble merchandise for free. No merchandise will be assembled without a 48 hour notice. If the Buyer wants to pick up the merchandise instead of having it delivered, the following options are available:
*Free Pick Ups: All items remain unassembled in the original manufacturer's box.
*Paid Pick Ups: Includes pre-inspection, assembly, and deluxing. The items are put back into the manufacturer's box or slightly wrapped for transportation after being assembled. Paid pick ups require a 48-hour notice giving the warehouse adequate time to prepare the merchandise. The price is $75.00 per hour. (It takes 15 minutes to assemble one dining chair; 4 chairs x 15 minutes = 60 minutes = $75)
The Buyer should thoroughly inspect the merchandise and note damages on the delivery receipt. FURNITURE MART IS NOT RESPONSIBLE FOR ANY DAMAGES AFTER THE MERCHANDISE IS DELIVERED.
Order Availability: Furniture Mart cannot provide a delivery date until your order has been received at the final mile warehouse. We will be happy to provide estimated delivery dates; however, actual availability may vary from this estimate. Furniture Mart has no control over factory production, schedule changes, or the accuracy of information furnished to us by the manufacturer or delivery services.
Furniture Mart shall not be responsible for delays or defaults in the delivery occasioned by weather, war, strikes, acts of nature, the public enemy, fire, labor, or transportation difficulties or other causes beyond the control of Furniture Mart. Furniture Mart shall not be liable to customers for any damages resulting from delivery delays. Buyer agrees that changes in availability will not invalidate this order.
Special Orders require manufacturer confirmation. Since manufacturers won't send automatic status updates, it's the buyer's responsibility to reach out to us for such updates. Should an item or fabric be delayed or discontinued, we will promptly notify the buyer. By proceeding with a Special Order, the buyer consents that such changes will not invalidate the rest of the order.
Damages: All merchandise is opened and inspected before delivery. If damage occurs, FURNITURE MART WILL REPAIR OR REPLACE AT THE ORIGINATING MANUFACTURER'S DISCRETION. FURNITURE MART MAKES NO WARRANTIES BEYOND THE WRITTEN DESCRIPTION OF THE GOODS. FURNITURE MART EXPRESSLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. This disclosure does not affect the manufacturer’s warranties if any. Merchandise is not guaranteed against excessive wear and use, fading, stretching, soling, pilling or pile crushing.
*All damaged items must be REFUSED at delivery. Refused items are returned to the delivery service’s final mile warehouse for disposition. If you REFUSE a damaged item at delivery, a repair, replacement, or refund will be provided based on the originating manufacturer’s discretion. Additional delivery, services, or pick up fees may apply.
*If you ACCEPT a damaged item at delivery, you have agreed to keep it As-Is, regardless of the notes on the delivery receipt. No repair or refund will be provided.
The Buyer should thoroughly inspect the merchandise and note the refusal for damages on the delivery receipt. Furniture Mart is not responsible for any damages once merchandise is delivered. The Buyers must note the type of damage, defect, or shortage at delivery on the delivery receipt and take photos of all sides of the original packing; failing to do so will result in claim denial. Furniture Mart reserves the right to refuse liability for any deficiency not notated on the delivery receipt. Claims must be submitted to Furniture Mart within 24 hours of signing the delivery receipt to avoid denial of a claim.

Cancellations: There are no refunds of deposits after (3) three days from the transaction date. Furniture Mart does not place orders for items on an approval basis. Please note that "not meeting expectations" is not the same as "incorrectly described." Furniture Mart offers no additional warranties beyond those stated in the written description of each item and disclaims all implied warranties, including those of merchantability or suitability for a particular use.
NO REFUNDS ON ANY DELIVERED MERCHANDISE. Damaged merchandise must be refused at delivery.
Purchase Categories:
*As-Is: All sales under this category are final. No refunds, returns, or services will be offered on these items.
*Get It Now: In-Stock: These items are currently available at a Furniture Mart showroom or storage facility.
*Short Lead Time: In Stock at Manufacturer: Items under this category are available for quick shipping from the manufacturer's warehouse. Full refunds are only available if the order is canceled before the manufacturer begins production or loads the item onto a shipping vehicle.
*Available to Special Order: These items need to be ordered from the manufacturer. Full refunds are only available if the order is canceled before the manufacturer begins production or loads the item onto a shipping vehicle.
Non-Cancelable Orders: Orders categorized as "Special Order" or "Short Lead Time: In Stock at Manufacturer" cannot be canceled or refunded once the manufacturing process has begun or the items have been loaded onto a shipping vehicle.
Miscellaneous:
Sales Tax may be adjusted according to state regulations prevailing at the time of delivery.
Errors in pricing: Mathematical and inadvertent errors are subject to revision by Furniture Mart.
Furniture Mart may cancel any order for any reason upon refund of any deposits.
FINANCING TERMS SHALL COMMENCE ON THE FIRST DATE MERCHANDISE IS DELIVERED.
Exclusive venue for any action relating to the enforcement or interpretation of this agreement shall be in the court of competent jurisdiction in and for Duval County, Florida. BUYER WAIVES THEIR RIGHT TO A JURY TRIAL IN ANY LAWSUIT RELATING TO THIS AGREEMENT. If any provision of this agreement shall be determined to be invalid or unenforceable for any reason, the remaining provisions of this agreement shall be unaffected thereby and shall remain in full force and effect. This agreement shall be binding upon and shall insure to the benefit of the respective parties and respective administrators, executors, other legal representatives, heirs, successors and permitted assigns.
Merchandise purchased before a manufacturer sales event is not eligible for the sale incentives.
All service fees are non-refundable; this includes but not limited to delivery fees, repair fees, disposal fees, cutting fees, etc.
THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN THE PARTIES AND SUPERSEDES ALL PRIOR VERBAL AND WRITTEN AGREEMENTS BETWEEN THE PARTIES.
Delivery Accessorial: Include but not be limited to the following provisions.
Storage Fee
$40 per piece and applies after the first 15 days of the item being received at the last-mile terminal. Storage fees are charged every 15 days.
Walkups above 2nd Floor
$20/piece/floor
Assembly Time / Extra Time on-site
Items that require up to 30 minutes of assembly or delivery time will not incur charges. Over 30 minutes of assembly or time on-site, all time will be charged at a rate of $31.25 per 15 minutes.
Heavy Item Surcharge
$165 for a single piece weighing 300 or more lbs. If a single piece is 450+ lbs., multiple increments of $165 may be charged to accommodate extra members on the delivery team.
Remote Charges
Some zip codes hold remote charges if a hub holds Remote Charges please note some zip codes may have remote fees of $55 per delivery. This is mainly seen in the Desert regions.
Oversized Fee
Oversized items over 101 inches will be charged at $150 extra per item for anything over 101 inches.
Repair
No charge if repair is due to Deliveright damage.
If repair is not due to a Deliveright error, the first 30 minutes will not be charged. If the repair takes 30 minutes or longer, $31.25 will be charged, with an additional $31.25 for each 15-minute increment. For example, a 30-minute repair would cost $31.25, while a 45-minute repair would cost $62.50.
Any additional materials required for the repair will be charged to Jacksonville Furniture Mart at cost.
Redelivery Charge
If redelivery is not due to Deliveright error, redelivery will be charged at the same last-mile rate as the original delivery.
Not-at-Homes
Redelivery will be charged at the same last-mile rate as the original delivery.
Refusals
The original, refused order will be charged at the same last-mile rate as the original delivery.
If the refusal is due to a Deliveright error, whether damage or another issue, Jacksonville Furniture Mart will not be charged for any redelivery or associated costs (for example, repair).
If the refusal is not due to a Deliveright error, for example, the customer changing their mind, they will be charged in full for any redelivery or associated costs.
Reschedule – Short Notice
Reschedules within 48 hours of the scheduled date will be 50% of the original delivery charge as a rescheduling fee.
Reschedules within 24 hours of the scheduled date will be 100% of the original delivery charge as a rescheduling fee.
Item Does not Fit
Items that do not fit into a home and are sent back to the hub for third party hand off will be charged additional cost.
Insurance Fee
Additional insurance can be purchased upon request.
8.5% of the value of additional insurance required, above base coverage amount. The base coverage amount will be calculated based on the order's details, and will be shown to Jacksonville Furniture Mart upon booking the order.
Deliveright will only cover a damage claim up to the total amount of insurance coverage on the order. For example, if there is $3,000 of insurance coverage on an order, Deliveright would only cover replacement costs up to $3,000. There is a maximum insurance total of $5,000 on any one order.

Disposal
No charge if disposal is due to Deliveright error. If disposal is not due to a Deliveright error, the charge will be $71 per piece.
Pickups
Pickups from customer homes will be charged at the rates above.
Exchanges
Exchanges will be charged at the rate as calculated above for the piece(s) being delivered, plus 50% of the original rate.
Any further action on the exchanged piece(s), whether transfer, return, packaging, disposal, will apply at separate rates.
Packaging
If Deliveright is to package a piece in order to return or transfer to another terminal, the charge will be $45 per piece.
Transfer / Reassignment
If Deliveright is to transfer an order between its terminals, the customer will be charged at the B2B/LTL rate for that given lane. To obtain info about these particular transfer costs, please contact Orders@JacksonvilleFurnitureMart.com in order to obtain a quote.
If Deliveright must package any piece(s) before transfer, charges will apply as described above.
Returns
If Deliveright is to return an order to the vendor due to a Deliveright error, whether damage or another issue, the customer will not be charged for the return.
If Deliveright is to return an order to the vendor due to another issue, the customer will be charged at the B2B/LTL rate for that given lane. For example, if returning an order from Deliveright's Elizabeth, NJ terminal to a vendor in NC, we will charge the B2B rate for the NJ - NC lane.

Out-of-area Deliveries
Deliveries to zip codes not included in Deliveright's coverage, or to zip codes to a state or from an origin point not included in the rates above, will be charged at a custom rate. Please contact Orders@JacksonvilleFurnitureMart.com in order to obtain a quote.
Fuel Surcharge
Fuel surcharge will be applied based on the Department of Energy’s East Coast U.S. On-Highway Diesel Fuel Prices. It is updated weekly based on changes in the average price. Please see below fuel surcharge index: https://www.deliveright.com/FSC/
